Accepting these Terms
These Terms describe the rights and responsibilities of everyone who visits or uses the Hub. Using it means you agree to them; if you do not, you must not use it.
You confirm that you are at least 18 years of age. We do not permit younger people to use the Hub.
Our Privacy Policy is part of this agreement. It explains what we do with personal information and what rights you have, so please read it as well.
Educational material only
The Hub publishes educational and informational material about managing everyday life. We are not your physician, therapist, lawyer, accountant or financial adviser. No page on the Hub can stand in for a qualified professional who knows the specifics of your situation, and we do not promise that any routine or suggestion will deliver a particular result for you.
Our content and your use of it
The articles, checklists, downloads, graphics, logos and page designs on the Hub belong to us or to those who license them to us, and they are protected by copyright and trademark law. You are welcome to read the Hub and to print or save pages for private, non-commercial purposes.
What you may not do: reproduce, republish, sell or scrape our material, build derivative works from it, reverse engineer any part of the Hub, disrupt its operation or security, or use it for anything unlawful.
Third-party websites
Links on the Hub may take you to outside websites or services that belong to others and are outside our control. Their content, policies and practices are their responsibility. Whatever you find through those links, you use at your own risk: we accept no direct or indirect liability for losses that result. Please read their terms and privacy policies.
Suspending or ending access
Access to the Hub can be suspended or terminated by us at any moment, for any reason, including a breach of these Terms, without advance warning and without liability on our part. Your right to use the Hub ends at that moment.
Limits of our responsibility
Regardless of the damages you may incur, everything the Company and its suppliers could owe you under these Terms, and the only remedy available to you, is capped at the amount you actually paid us through the Hub, or 100 US dollars if you have paid nothing.
As far as the law permits, the Company and its suppliers bear no liability for damages that are special, incidental, indirect or consequential, including lost profits, lost data, business interruption, personal injury or loss of privacy, however they arise from the Hub, from third-party software or hardware used with it, or from any part of these Terms. This holds even if we knew such damages were possible, and even if a remedy does not achieve its purpose.
A few states do not allow implied warranties to be excluded or incidental or consequential damages to be limited. If you live in one of them, the limits above apply only as far as that state permits.
Provided as it is
The Hub comes to you as it is and as it is available, faults included, with no warranty of any kind. As far as the law allows, we, our Affiliated companies and our licensors and service providers disclaim every express, implied or statutory warranty, among them the implied warranties that goods are merchantable, that they suit a particular purpose, that title is good and that nothing infringes, and any warranty that could arise from past dealings between us, from how the agreement has been performed, or from trade custom.
We do not warrant that the Hub will meet your requirements, achieve any intended result, cooperate with other software, systems or services, operate uninterrupted, satisfy any benchmark for performance or reliability, or be free from errors, or that errors will be corrected. We make no warranty about the accuracy, reliability or currency of anything published on the Hub, or that the Hub, its servers or our emails are free of viruses, scripts, worms, malware, time bombs or other harmful code.
Where a jurisdiction does not allow some of these exclusions or limits consumer rights that cannot be waived, the exclusions apply to the fullest extent that jurisdiction permits.
Governing law
These Terms and your use of the Hub are governed by the laws of the State of Texas, leaving aside its conflict-of-law principles. Other local, state, national or international laws may apply to you as well.
Disagreements
Should you have a complaint about the Hub, please tell us first so that we can try to sort it out informally.
European Union residents
If you are a consumer living in the European Union, you keep whatever mandatory protections the law of your country of residence grants you.
Sanctions and export rules
You confirm that you are not in a country under a United States embargo or one the United States has designated as supporting terrorism, and that no United States government list of restricted or prohibited persons includes you.
If part of this fails
Should a court decide that any part of these Terms is invalid or cannot be enforced, that part will be read as narrowly as needed to make it valid while preserving its intent, and the remainder stays fully in force.
If we fail to insist on a right or to require you to meet an obligation, we are not giving it up for the future, and letting one breach pass does not excuse the next.
Language
Should we offer these Terms in another language, the English text prevails if the versions differ.
Changing these Terms
We may amend or replace these Terms whenever we see fit. For material changes we aim to give at least 30 days' notice before they take effect, and what counts as material is for us to judge. If you keep using the Hub after a change applies, you accept it; if you do not accept it, please stop using the Hub.
